Reports of violations observed at the Klaipėda Culture Communication Centre (hereinafter – KCCC) may be submitted by current and former KCCC employees or by persons connected with the KCCC through contractual relations (traineeships, internships, voluntary work and the like).
A violation – is a criminal act, administrative offence, official misconduct or breach of work duties that may be in preparation, in progress or already committed at the institution, as well as a gross breach of mandatory professional ethics, an attempt to conceal such a violation, or any other legal violation that threatens or harms the public interest, of which the person reporting the violation learns from their current or former service, employment or contractual relations with the institution, or during recruitment or other pre-contractual relations.
Reports are submitted in order to protect the public interest. Information submitted solely to defend personal interests will not be regarded as a report.
In order to provide proper opportunities to report legal violations and to ensure their prevention and disclosure, the Law on the Protection of Whistleblowers establishes:
- the grounds and forms of protection for persons who report violations in institutions;
- the rights and duties of persons who report violations in institutions;
- measures for the protection and encouragement of, and assistance to, persons who report violations in institutions.
You can submit information about a violation in the following ways:
- To the KCCC through the internal reporting channel – by e-mail: pranesk@kkkc.lt
- we recommend submitting the report by completing this violation report form
- or by a free-form report stating who, when, in what way and what violation is being prepared, is being committed or has been committed, and so on; the date and circumstances on which you learned of the violation; your name, surname, personal identification number or date of birth, place of work and contact details: e-mail address and other data for keeping in touch; and stating that this information is submitted under the Law on the Protection of Whistleblowers.
- Directly to the competent person at the KCCC: Žana Jegorova, tel. +370 690 073 65, or by coming to the address given (Didžioji Vandens g. 2, LT-91246) and approaching this person in person;
- IMPORTANT. When sending a report of a violation by post, the marking “Personally to the competent person„.
- Directly to the Prosecutor’s Office.
- A person reports a violation directly to the competent institution where at least one of the following circumstances applies:
- the violation is of essential importance to the public interest;
- it is necessary to prevent or stop the violation as quickly as possible, because major damage may occur;
- the managers or persons linked to the institution by employment or contractual relations may themselves be committing or have committed violations;
- information about the violation was submitted through the internal reporting channel, but no reply was received, no action was taken in response, or the measures taken were ineffective;
- there are grounds to believe that, if the information is submitted through the internal reporting channel, the whistleblower’s anonymity or confidentiality may not be ensured, or that there will be an attempt to conceal the reported violation;
- the institution has no functioning internal reporting channel;
- the person cannot use the internal reporting channel because they are no longer linked to the institution by employment or other legal relations.
- A person reports a violation directly to the competent institution where at least one of the following circumstances applies:
- Publicly.
- Information about a violation may be made public in order to report an imminent danger to human life, public health or the environment, where urgent action is needed to prevent such a threat and, for lack of time, there is no possibility of reporting the violation by other means, or where reporting by other means did not lead to the necessary action being taken in time.
Under the Law, information about violations is submitted concerning:
- danger to public security or health, or to a person’s life or health;
- danger to the environment;
- obstruction of, or unlawful influence on, investigations by law enforcement institutions or on the administration of justice by the courts;
- the financing of unlawful activities;
- unlawful or non-transparent use of public funds or property;
- property acquired by unlawful means;
- concealment of the consequences of a committed violation, or obstruction of establishing the extent of those consequences;
- other violations.
Confidentiality will apply to the person who submits information about a violation. The requirement to ensure confidentiality does not apply only in the following cases:
- the person submitting or having submitted the information requests this in writing;
- the person submits knowingly false information.
